TOS:

1. Introduction

These Terms of Service ("ToS") govern the use of the 3D asset ("Asset") provided by PAM. ("Licensor"). By downloading, purchasing, or otherwise using the Asset, you ("Licensee") agree to comply with these terms.

2. Grant of License

Upon purchase or download, the Licensee is granted a non-exclusive, non-transferable, revocable license to use the 3D Asset under the conditions set forth in this ToS.

3. Permitted Uses

You are permitted to use the 3D Asset for the following purposes:

• Personal use: For non-commercial personal projects such as rendering, animation, 3D printing, VRchat commissions, etc.
• Commercial use: For use in commercial projects, including video games, virtual reality, film production, etc., provided that such use adheres to the restrictions in Section 4 below.

4. Prohibited Uses

You may not:

• Sell, distribute, or sublicense the 3D Asset (either in its original form or modified) as a standalone product or part of any other asset pack.
• Modify the Asset in ways that enable it to be resold or distributed as part of a 3D model marketplace or in similar contexts.
• Claim ownership of the Asset or present it as your own original work.
• Use the Asset in any illegal, defamatory, or offensive content, including but not limited to hate speech, violence, or pornography.
• Reverse-engineer, decompile, or disassemble the 3D Asset.
• Integrate the Asset in any software, platform, or project that enables others to easily download or extract it without my express permission.

5. Attribution

When using the Asset in any project, the Licensee must provide proper attribution to the Licensor in accordance with the following:

• Attribution should be clearly visible in any credits or acknowledgments of the project where the Asset is used.
• The format of the attribution should be as follows: “3D Asset provided by PAM..”

6. Ownership and Intellectual Property

• The 3D Asset and all intellectual property rights remain the sole property of the Licensor.
• The Licensee is granted a license to use the Asset under the terms set forth in this ToS, but does not receive ownership rights or any other intellectual property rights in the Asset.

7. Termination

The Licensor may terminate this agreement and revoke the Licensee’s access to the Asset at any time if the Licensee fails to comply with these Terms of Service. Upon termination, the Licensee must immediately cease all use of the Asset and destroy all copies in their possession.

8. Disclaimer

The 3D Asset is provided "as-is" without warranties of any kind. The Licensor does not guarantee the Asset will meet the Licensee’s needs or function as expected in every environment.

9. Limitation of Liability

In no event will the Licensor be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising out of the use or inability to use the 3D Asset.

10. Indemnification

The Licensee agrees to indemnify, defend, and hold harmless the Licensor from any claims, damages, losses, or expenses arising from the Licensee’s use of the 3D Asset in violation of these Terms of Service.

11. Governing Law

These Terms of Service will be governed by and construed in accordance with the laws of YOUR RESPECTIVE COUNTRY. Any legal actions related to these terms will be brought in the appropriate courts of YOUR RESPECTIVE COUNTRY.

12. Modifications to Terms

The Licensor reserves the right to modify these Terms of Service at any time. Any changes will be posted on HERE and will be effective immediately upon posting.
